Influenza mandates in health care institutions are recommended by professional associations as an effective way to prevent the contraction of influenza by patients from health care workers. Health care institutions with such mandates must operate within civil rights frameworks. A recent set of cases against health care institutions with influenza mandates reveals the liabilities posed by federal law that protects employees from religious discrimination. This article examines this legal framework and draws important lessons from this litigation for health care institutions. (...) In their thoughtful, nuanced and interesting discussion, Jonathan Pugh, Julian Savulescu, Rebecca Brown and Dom Wilkinson argued that officials should recognise proof of prior infection as a valid exemption from vaccination requirements.1 This commentary agrees with parts of their analysis, but argues that the case for the exemption is less clear than the authors suggest, and the better approach is to allow officials flexibility: an exemption for natural immunity may be appropriate or may not. In part, the disagreements may stem (...) from different experiences in different societies. The authors are in the UK, and their experience may differ from the USA in multiple ways, three very glaring. First, the UK broadly used the AstraZeneca vaccine, which has higher risks than the mRNA vaccines, so our assessment of vaccine risks differs. Second, the UK has universal health insurance, so some of the access to testing issues that I raise concerns about may not apply there. And third, the risk of fraud or misrepresentation may be less in the UK—and other countries—than in the USA, where real concerns about, for example, fake vaccine cards have led to multiple arrests.2 Another issue is that information about COVID-19 changes fast—what was known when the authors wrote may no longer fit the current picture. In their article, the authors argue that it is ethically imperative that COVID-19 mandates exempt those with natural immunity. The authors argue that those who have become immune through infection are ‘potentially equivalent’ to those who were vaccinated, and refusing them an exemption is ethically unjustified—they call this the ‘unnaturalistic fallacy’. This article argues that the Supreme Court should not require a religious exemption from vaccine mandates. For children, who cannot yet make autonomous religious decision, religious exemptions would allow parents to make a choice that puts the child at risk and makes the shared environment of the school unsafe — risking other people’s children. For adults, there are still good reasons not to require a religious exemption, since vaccines mandates are adopted for public health reasons, not to target religion, are (...) an area where free riding is a real risk, no religion actually prohibits vaccinating under a mandate, and policing religious exemptions is very difficult. Employers and governments are interested in the use of serological testing to allow people to return to work before there is a vaccine for SARS-CoV-2. We articulate the preconditions needed for the implementation of antibody testing, including the role of the U.S. Food & Drug Administration.

While vaccination rates in the United States are high — generally over 90 percent — rates of exemptions have been going up, and preventable diseases coming back. Aside from their human cost and the financial cost of treatment imposed on those who become ill, outbreaks impose financial costs on an already burdened public health system, diverting resources from other areas. This article examines the financial costs of non-vaccination, showing how high they can be and what they include. It makes a (...) case for requiring those who do not vaccinate to cover the costs of outbreak caused by their choice. Such recouping is justified because the choice not to vaccinate can easily be seen as negligent. But even if it is not, that choice involves imposing costs on others, and there are good reasons to require the actors to internalize those costs. The article proposes alternative statutory and regulatory schemes to cover the costs imposed on the public purse, focusing on no-fault mechanisms. We consider both ex ante mechanisms like a tax or a fee that will go into a no-fault fund to cover the costs and ex post mechanisms like a statutory authorization for recoupment of those costs by health officials. Laws and policies are vital tools in preventing outbreaks and limiting the further spread of disease, but they can vary in content and implementation. This manuscript provides insight into challenges in responding to recent vaccine-preventable disease outbreaks by examining legislative changes in California, policy changes on certain university campuses, and the laws implicated in a measles outbreak in Minnesota.

One of the major values of animal ethical theory can be found in the light it sheds on practical ethical problems involving animals. McCulloch and Reiss’ paper does precisely this regarding the culling of badgers in England to limit the spread of tuberculosis. Perspicaciously realizing that societal ethics represents a combination of utilitarian and rights-based theorizing, the authors apply both of these perspectives to the issue, noting that both theoretical approaches generate a rejection of culling in the presence of (...) other viable alternatives. In addition, the authors suggest and defend the use of an Animal Welfare Impact Assessment tool to assess the impact of various management approaches on the animals, and demonstrate its congruence with both the ethical theories considered, and with societal moral attitudes. In this way, they show that their conclusion is directly compatible with the societal ethic, in my view a major prerequisite for effecting social change. (shrink)

This essay examines the relationship between slavery and plant knowledge for cultivational activities and medicinal purposes on Isle de France (Mauritius) in the second half of the eighteenth century. It builds on recent scholarship to argue for the significance of slaves in the acquisition of plant material and related knowledge in pharmaceutical, acclimatization, and private gardens on the French colonial island. I highlight the degree to which French colonial officials relied on slaves’ ethnobotanical knowledge but neglected to include such information (...) in their published works. Rather than seeking to explore the status of such knowledge within European frameworks of natural history as an endpoint of knowledge production, this essay calls upon us to think about the plant knowledge that slaves possessed for its practical implementations in the local island context. Both female and male slaves’ plant-based knowledge enriched – even initiated – practices of cultivation and preparation techniques of plants for nourishment and medicinal uses. Here, cultivational knowledge and skills determined a slave’s hierarchical rank. As the case of the slave gardener Rama and his family reveals, plant knowledge sometimes offered slaves opportunities for social mobility and, even though on extremely rare occasions, enabled them to become legally free. When sharing a task with another person that requires turn taking, as in doubles games of table tennis, performance on the shared task is similar to performing the whole task alone. This has been taken to indicate that humans co-represent their partner’s task share, as if it were their own. Task co-representation allows prediction of the other’s responses when it is the other’s turn, and leads to response conflict in joint interference tasks. However, data from our lab cast doubt on (...) the view that task co-representation and resulting response conflict are the only or even primary source of effects observed in task sharing. Recent findings furthermore suggest another potential source of interference in joint task performance that has been neglected so far: Self-other discrimination and conflict related to agent identification (i.e., determining whether it is “my” or the other’s turn). Based on these findings we propose that participants might not always co-represent what their partner is supposed to do, but instead co-represent that another agent is responsible for part of the task, and when it is his turn. This paper claims that indefinite descriptions, singular and plural, have different scope properties than genuine quantifiers. This claim is based on their distinct behavior in island constructions: while indefinites in islands can have intermediate (and maximal) scope readings, quantifiers cannot. Further, the simplest in situ interpretation strategy for indefinites results in incorrect truth conditions for intermediate (and maximal) scope readings. I introduce a mechanism which “auto-matically” preserves the restriction on free variables corresponding to indefinites, in a way which allows the (...) restriction to be carried up in the course of semantic interpretation and to be used at the level where the variable is quantified. This mechanism is a realization of the “indefinites-as-free-variables” proposal of Lewis, Kamp, and Heim, but emphasizes the role of the restriction. I then show that distributive readings of plural indefinites also display island-escaping behavior and argue for an independent, island-insensitive distribution mechanism. (shrink)

Philosophical debates about the mental life of non-human animals provide an especially vivid illustration of how radically philosophers‘ intuitions concerning other minds can diverge. Do animals have mental states? Of what sort? Do any of the beasts have minds that overlap with ours? Is there any significant continuity between their minds and ours? Davidson is well known for arguing that, for conceptual reasons, at least when it comes to beliefs and other propositional attitudes, non-human animals differ from us in having (...) none. For example, he has argued that having beliefs requires having the concept of belief, which in turn requires language (Davidson (2001a), (2001b)). He has also argued that possession of any propositional attitude presupposes possession of belief, and that attributing any propositional attitude to a creature requires crediting them with the concepts that figure in the specification of the attitude‘s content (Davidson (2001a), (2001b) (2004)). Davidson‘s arguments are tantalizing, but also puzzling, and far from explicit; and they have been subjected to sharp scrutiny and powerful objections from a number of authors in recent years. This paper aims (a) to provide characterizations of realism and instrumentalism that are philosophically interesting and applicable to economics; and (b) to defend instrumentalism against realism as a methodological stance in economics. Starting point is the observation that ‘all models are false’, which, or so I argue, is difficult to square with the realist's aim of truth, even if the latter is understood as ‘partial’ or ‘approximate’. The three cheers in favour of instrumentalism are: (1) Once we have usefulness, truth (...) is redundant. (2) There is something disturbing about causal structure. What is the correct concept behind measures of inflation? Does money cause business activity or is it the other way around? Shall we stimulate growth by raising aggregate demand or rather by lowering taxes and thereby providing incentives to produce? Policy-relevant questions such as these are of immediate and obvious importance to the welfare of societies. The standard approach in dealing with them is to build a model, based on economic theory, answer the question for the model world and then (...) apply the results to economic phenomena outside. Data come in, if at all, only in testing a limited number of the model's consequences. Despite some critical voices, economic methodology too has by and large subscribed to a "theory first" approach to applied economics. Error in Economics systematically develops an alternative to the theory-based orthodoxy. It places the methodical study of evidence at the centre of the scientific enterprise and thus provides a foundation for a methodology of evidence-based economics. But the book does not stop at the truism that claims should be based on the best available evidence. Rather, detailed studies in the areas of measurement, causal inference and policy analysis show what it means for a claim to be evidence-based in the context of a concrete case. The examples discussed concern topics as diverse as consumer price indices, radio spectrum auctions, the transmission mechanism, natural experiments on minimum wages and the evaluation of counterfactuals for policy. “Counterfactual” readings of might/could have were previously analyzed using metaphysical modal bases. This paper presents examples and scenarios where the assumptions of such a branching-time semantics are not met, because there are facts at the base world that preclude the complement of the modal becoming true. Additional arguments show that counterfactual readings are context dependent. These data motivate a semantics using a circumstantial (or factual) modal base, which refers to context-dependent facts about a world and time. Evidentialism is the view that facts about whether or not an agent is justified in having a particular belief are entirely determined by facts about the agent’s evidence; the agent’s practical needs and interests are irrelevant. I examine an array of arguments against evidentialism (by Jeremy Fantl, Matthew McGrath, David Owens, and others), and demonstrate how their force is affected when we take into account the relation between degrees of belief and outright belief. Once we are sensitive to one of (...) the factors that secure thresholds for outright believing (namely, outright believing that p in a given circumstance requires, at the minimum, that one’s degree of belief that p is high enough for one to be willing to act as if p in the circumstances), we see how pragmatic considerations can be relevant to facts about whether or not an agent is justified in believing that p—but largely as a consequence of the pragmatic constraints on outright believing. This research set out to measure the impact of the lockdown condition and social distancing imposed on higher education by the Israeli government during the COVID-19 period and the shift to online learning, on students’ emotional well-being, the way they perceived their teachers’ just behavior, and faculty incivility, compared to pre-pandemic conditions. An additional aim was to explore the set of connections among these factors. The total sample included 396 undergraduate students from three academic colleges. Data were gathered via three (...) questionnaires: Positive/negative affect, Faculty Incivility, and Teacher Justice. Data were analyzed using Partial Least Squares-Structural Equation Modeling. The main finding showed that students’ negative emotions were informed by the lockdown condition. This perceived negative affect had an impact on how the participants experienced social interactions with their faculty. Those who exhibited higher levels of negative affect perceived themselves as targets of faculty incivility. The same trajectory was detected with the way students experienced their teachers’ just behavior. Students who held negative emotions, partly because of the COVID-19 restrictions, also viewed their teachers’ behavior toward them as unjust. This study stresses the role of one’s emotional condition in instigating negative interpretations of social interactions. Directions for subsequent research and practical implications for promoting students’ well-being and civil and just communications in the learning environment are discussed. (shrink)

Indépendamment de leur préférence ou de leur ambivalence à l’égard de la parenté génétique, la majorité des participants étaient conscients des autres options parentales et en ont noté les avantages et les inconvénients. Cependant, la connaissance des options parentales alternatives n’était pas uniforme.Conclusions : Afin de garantir que les patients adolescents et leurs parents prennent des décisions relatives à la PF qui répondent à leurs objectifs et valeurs personnels, il est important que les médecins discutent avec eux des options parentales alternatives en tenant compte de leur culture. This study examines the distribution of complex nominal constructions in Hebrew texts produced by non-expert schoolage and adult writers, compared with their distribution in expert-written encyclopedic texts. One aim of the paper was to determine young writers’ ability to distinguish text types through their usage of genre-appropriate morpho-syntactic forms. Another aim was to investigate the distribution of these constructions in expert school-related texts so as to confirm or refute the hypothesis of “resonance” between input and output texts. The study population (...) consisted of native Hebrew-speaking gradeschoolers, adolescents and adults who each produced 2 written texts, one biographical, one expository. The same text types were analyzed in three encyclopedias, targeted for use in each of the age groups under discussion. Our analysis indicates that non-expert writers’ textual output undergoes marked developmental changes during later childhood and adolescence, but no developmental resonance was found in expert texts, which constitute part of the input that novice and non-expert writers are exposed to. Implications for the nature of the mental lexicon and its relationship with grammar are discussed. (shrink)

The present research is the first part of econometric study of the so called sponsored goods and looks at one of the most common types of such goods namely art products created by theaters, concert organizations and museums. The aim of the paper is to analyse the performance of Russian art organizations to find out to what extend the conditions of their functioning in post Soviet times under the development of market economy, democratization of leisure and changes in consumer preferences (...) influence their economic results. Could Russian theaters, museums and concert organizations be self- sufficient in market economy established in Russian in 1991-2010?The set up task determined the object of the study and the statistical data to be used-40 years time series performance indicators that include equal time intervals-1971-1990 for performing arts organizations and 1991-2010-for theaters, concert organizations and museums. The specifics of calculations presented in the article result from the very approach to the testing of cost disease. Its essence is to reveal the symptoms of this disease in art organizations taken as an element of economy as a whole rather than only as a part of cultural activities. Accordingly a new method of diagnostics of the cost disease is suggested that is based on development of specific indexes measuring the lag of labor productivity, advancing dynamics of wages and priority growth in prices for tickets in relation to the corresponding indexes of macroeconomic dynamics as well as determination of cost disease consequences-the deficit of income of providers of cultural goods. The implementation of such an approach allowed to construct three-dimensional space which coordinates describe the dynamics of performance results of art organizations. (shrink)

The attribution of complexity in the broadest sense of the term does not satisfy our curiosity as to the possible interdependence between style and society. Interestingly enough, as far as late fourteenth-century chansons style is concerned, such an association can even be countered, considering the coincidental cultivation of the new simple style in the complex and decadent Burgundian courts of the waning Middle Ages. 6Here I propose to examine the late fourteenth-century musical style not on the background of social procedures but in the context of fourteenth century scientific thought, and to demonstrate immanent and structural cohesion between a compositional trend that features manipulations within the dimension of musical time and the sciences which investigate the properties of time qua continuum. This affinity concerns a parallel, yet not a completely overlapping, development directed towards the ultimate refinement of the notion of mensura. In other words we are dealing here... (shrink)

The purpose of this study is to trace junior high school teachers? perspectives regarding the strengths and weaknesses of their type of school, and to glean more information concerning their preferable type of grade configuration. To this end, 25 teachers filled out an open questionnaire and six of them were further interviewed to provide more insight into the teachers? responses. Surprisingly, most of the teachers tended to strongly support the 1?8 type elementary schools rather than the current situation of 1?6, (...) 7?9, 10?12 in which they have ever worked. All univocal analyses of causation face counterexamples. An attractive response to this situation is to become a pluralist about causal relationships. "Causal pluralism" is itself, however, a pluralistic notion. In this article, I argue in favor of pluralism about concepts of cause in the social sciences. The article will show that evidence for, inference from, and the purpose of causal claims are very closely linked. Key Words: causation • pluralism • evidence • methodology.

A behavioral dataset contains various preference orderings displayed by the same individual in different payoff-irrelevant circumstances. We introduce a framework for eliciting the individual’s underlying preferences in such cases, in which it is conjectured that the variation in the observed preference orderings is the outcome of some cognitive process that distorts the underlying preferences. We then demonstrate for two cognitive processes how to elicit the individual’s underlying preferences from behavioral datasets.

An Aims-based Curriculum spells out a ground-breaking alternative to the familiar school curriculum constructed around a number of largely academic subjects. Its starting point is not subjects, but what schools should be for. It argues that aims are not to be seen as high-sounding principles that can be easily ignored: they are the lifeblood of everything a school does. -/- The book begins with general aims to do with equipping each learner to lead a personally fulfilling life, and to help (...) others to do so too. From these, they derive more specific aims covering the personal qualities, skills and understanding needed for a life of personal, civic and vocational well-being. -/- The second half of the book, on political realities of implementation, takes this process of aims-derivation further. Some of its detailed aims, but by no means all, overlap with conventional curriculum objectives. It also looks at the role of the state in curriculum decisions, as well as the implications of the book’s central argument for student choice, school ethos, assessment, inspection and teacher education . A recent movement in the social sciences and philosophy of the social sciences focuses on mechanisms as a central analytical unit. Starting from a pluralist perspective on the aims of the social sciences, I argue that there are a number of important aims to which knowledge about mechanisms—whatever their virtues relative to other aims—contributes very little at best and that investigating mechanisms is therefore a methodological strategy with fairly limited applicability. This article examines the Israeli documentary My Land Zion and the Palestinian documentary Paradise Lost. Both films are critical autobiographical texts and in both, the woman filmmaker negotiates her emotional and ideological ties with her culture, history, and nation. Naaman proposes that by using the autobiographical genre and by engaging emotionally as well as rationally, the women filmmakers discussed offer a particular gendered position rebelliously outside nationalism and the place of women within it.

In this accessible guide, science educator Michael J. Reiss and philosopher Michael Ruse argue that organicism-rather than mechanism-is the best way to understand the nature of life, and detail the resulting implications for biology, philosophy, education, and policy.

Pictorial free perception reports are sequences in comics or film of one unit that depicts an agent who is looking, and a following unit that depicts what they see. This paper proposes an analysis in possible worlds semantics and event semantics of such sequences. Free perception sequences are implicitly anaphoric, since the interpretation of the second unit refers to the agent depicted in the first. They are argued to be possibly non-extensional, because they can depict hallucination or mis-perception. The semantics (...) proposed here employs an account of anaphora using discourse referents, a formalized possible worlds semantics for pictorial narratives, and, to model the epistemic consequences of perceptual events, the event alternative construction from dynamic epistemic logic. In intensional examples, the second unit depicting what is seen is analyzed as embedded. It is argued that a semantics for embedding where the attitudinal state of the depicted agent is required to entail the semantic content of the picture attributes too much information to the agent. This is addressed with a model of normal looking, and a semantics for the embedding construction that uses existential quantification over alternatives, rather than universal quantification. . A psychological theory of religious experiences, sensitivity theory, is proposed. Whereas other theories maintain that religious motivation is about a few overarching desires, sensitivity theory provides a multifaceted analysis consistent with the diversity, richness, and individuality of religious experiences. Sixteen basic desires show the psychological foundations of meaningful experience. Each basic desire is embraced by every person, but to different extents. How we prioritize the basic desires expresses our individuality and influences our attraction to various religious images and activities. (...) Each basic desire is associated with a basic goal and a unique joy, such as love, self-worth, relaxation, or strength. We do not seek to experience joys infinitely; we regulate joys, in accordance with our core values, to sixteen balance points (sensitivities) that vary based on individuality. Religions help persons of faith regulate the sixteen basic joys by providing some images that strengthen joyful experiences and others that weaken them. We can strengthen our experience of self- worth, for example, by contemplating God in the image of savior; we can weaken our experience of self-worth by contemplating original sin. The theory of sixteen basic desires is testable scientifically and suggests such philosophical concepts as value-based happiness. (shrink)

This study was aimed at formulating a model to examine the potential value of perceived constructivist pedagogical practices in decreasing tendency to neutralize academic cheating through a psychological outcome of academic self-efficacy, in three academic learning settings: new learning environments, traditional face-to-face learning environments and distance learning environments. Data were collected from a sample of 289 undergraduate college students. Path analysis main results showed positive connections between the extent to which constructivist practices are present in the learning settings, as perceived (...) by the participants, and SE, which in turn reduced the tendency toward justifying academic cheating. Analysis of variance results showed that most of the constructivist dimensions were perceived by students enrolled in the NLE as relatively highly present compared with the other groups. Moreover, NLE students held more positive academic SE beliefs and were less inclined toward academic cheating justification than the other groups. Interpretation of these results and implications for future research are discussed. (shrink)
